Purchase Terms for access to Telegram groups and channels

1. Purpose

These Terms govern the purchase of access to Telegram groups or channels offered by creators through Comminari.

The specific access purchased, including group or channel, plan, price, duration, payment mode and renewal, is the one shown in the purchase summary immediately before starting payment.

2. Parties

The seller and provider of access is the creator or economic owner of the group or channel indicated in the purchase flow.

Comminari acts as a technology platform to facilitate access presentation, checkout, technical access management and certain operational communications. Unless expressly stated otherwise, Comminari is not the seller of the content or the main provider of the purchased access.

Comminari does not create, review or guarantee content published by the creator, nor does it assume tax, commercial or professional obligations corresponding to the creator for the sale of access.

3. Purchased access

The user acquires a personal, limited and non-transferable right of access to the selected Telegram group or channel.

Unless expressly indicated by the creator, access allows entry from activation and does not guarantee availability of historical content prior to the user's entry.

The creator may define the content, topic, activity frequency, internal rules and ordinary management of the group or channel.

4. Price, duration and renewals

The price, currency, taxes included when applicable, access duration and payment mode are those indicated in the purchase summary and in Stripe Checkout.

One-time payments grant access during the indicated period. Subscriptions renew automatically according to the displayed interval, unless cancelled.

The user may cancel a subscription before the next billing period through the enabled management tools. If a subscription is cancelled, access will continue until the end of the already paid period, unless these Terms or the group rules are breached.

Non-payment, failed payment, dispute, refund, chargeback or loss of subscription validity may imply suspension or revocation of access.

5. Delivery and immediate access

After payment confirmation, Comminari generates or shows an invitation link associated with the Telegram user validated during the purchase flow. A link may also be sent by email.

By accepting these Terms, the user expressly requests that access be delivered immediately after payment and acknowledges that, once digital access is delivered, they may lose the withdrawal right under applicable law.

If the link expires or does not work and the payment remains active, the user may request a new access link from the enabled management page.

6. Refunds

No voluntary refunds are offered once access has been delivered, without prejudice to mandatory rights that may correspond to the user under applicable law.

Requests based on a clear and documented technical error, duplicate charge, delivery impossibility attributable to the system or sufficiently proven manifest breach may be manually reviewed.

Any refund, accepted dispute or cancellation for non-payment may imply immediate revocation of access to the group or channel.

7. Group rules and user conduct

The user must respect the rules established by the creator for each group or channel.

Breach of internal rules, abuse of the service, resale of access, fraudulent use, spam, harassment or any illegal conduct may lead to removal and loss of access without automatic refund right.

Access may also be revoked or limited in case of attempts to bypass technical controls, use of unauthorized identities, payment dispute, refund, fraud, loss of technical bot permissions, archive or deletion of the group by the creator, or any situation preventing access from being maintained safely or operationally.

8. Content and creator responsibility

The creator is responsible for the description of access, offered content, promises made to the user and ordinary management of the community.

Comminari does not guarantee the accuracy, quality, usefulness, legality, continuous availability or results derived from content published by the creator, nor does it validate advice, recommendations, returns, results or promises made inside the community.

If the group covers sensitive or regulated matters such as investment, finance, health, fitness, education, gambling, adult content or other categories subject to specific requirements, the creator is responsible for complying with applicable rules and the user must assess the suitability of the content in their jurisdiction.

9. Age and capacity

The user declares that they have sufficient age and legal capacity to purchase and access the group or channel content in their jurisdiction.

If the user is a minor, they declare that they have authorization from their legal representatives and must not purchase or access content that is not appropriate for their age or country.

10. Payments and receipts

Payments are processed through Stripe. The charge is made to the connected account of the creator or access provider, and Comminari may receive a technical commission per transaction.

Stripe may issue receipts or proof of payment. Issuing invoices or tax receipts, when legally required, corresponds to the seller or access provider unless another model is expressly indicated.

The user understands that Stripe acts as an external payment provider and that its own terms and policies may apply to payment processing.

11. Third-party dependency

The technical provision of the service depends on third parties such as Telegram, Stripe, email providers, infrastructure and databases.

Incidents, policy changes, limitations, interruptions or technical decisions by these third parties may temporarily affect checkout, payments, invitation generation, user validation or access to the group or channel.

Comminari will act reasonably to restore operations when a technical incident affects the service, but does not guarantee uninterrupted availability of third-party systems.

12. Support and claims

Questions related to content, commercial promises, internal rules or group continuity should be addressed primarily to the creator.

Comminari may provide technical support related to checkout, Telegram validation, link generation, payment status and platform operation.

13. Privacy and data protection

The processing of personal data by Comminari is governed by the Privacy Policy published at /privacy.

External providers may participate in payment processing, Telegram user validation, access management and support as indicated in that Privacy Policy.

14. Changes to the Terms

Comminari may update these Terms. Each purchase is linked to the version accepted when checkout starts.

Historical versions may remain available for consultation and proof of acceptance.

15. Governing law

These Terms will be interpreted primarily under Spanish law, without prejudice to mandatory rights that may correspond to consumers in their country of residence.

If a translation is published, the Spanish version will prevail in case of discrepancy, unless an applicable mandatory rule provides otherwise.
