Creator Terms

Version 1.0. Effective from May 24, 2026.

1. Purpose

These Terms govern the use of Comminari by creators, administrators or economic owners who connect Telegram groups or channels to configure access plans, payments, discounts and automations.

Comminari provides a technology platform to manage charges, access, renewals, incidents and activity linked to private communities. These Terms do not govern purchases made by end users, which are subject to the applicable Purchase Terms.

2. Creator account

To use the private area, the creator must register an account, verify their email address and keep access credentials secure and up to date.

The creator is responsible for all activity carried out from their account, including connecting groups or channels, creating plans, configuring discounts, assigning internal roles and managing payments.

Comminari may apply limits, validations or security measures to prevent abuse, fraud, unauthorized access or misuse of the platform.

3. Comminari's role

Comminari acts as a technology platform to facilitate private community setup, payment page presentation, technical validation of Telegram users and operational access management.

Comminari does not create, review or guarantee content published by the creator inside Telegram, nor does it act as seller of the content unless expressly stated otherwise.

Comminari does not guarantee financial results, audience growth, content quality, profitability, or educational, sports, financial or professional outcomes derived from the creator's community.

4. Creator responsibility

The creator is responsible for the description of their community, commercial promises made, published content, internal rules, ordinary member support and legal compliance applicable to their activity.

The creator must ensure that prices, duration, payment mode, renewal, included benefits, limitations and access conditions are clear, truthful and not misleading.

When the community covers sensitive or regulated matters, such as investment, finance, health, fitness, education, gambling, adult content or other categories subject to specific requirements, the creator is responsible for complying with applicable rules and avoiding unlawful or misleading promises.

5. Telegram and access management

The creator must have sufficient permissions over the connected group or channel and allow the Comminari bot to have the permissions needed to validate users, generate invitations, check statuses and manage access.

The creator authorizes Comminari to activate, maintain, limit, cancel or revoke access when needed based on payment status, subscription, dispute, refund, plan configuration or loss of technical permissions.

Telegram is an external service. Policy changes, limitations, interruptions, loss of permissions or technical decisions by Telegram may affect automation availability.

6. Stripe Connect and payments

To enable charges, the creator must connect a valid Stripe account and complete the requirements requested by Stripe to operate, receive payments and keep the account enabled.

Stripe processes payments and may apply its own terms, verifications, fees, reserves, restrictions, blocks, risk policies and information obligations. The creator must accept and comply with the applicable Stripe agreements.

Comminari may use technical information provided by Stripe to create checkouts, calculate payment statuses, reconcile access, show activity, record incidents and apply platform fees.

7. Plans, prices and discounts

The creator may configure one-time payment plans, subscriptions, custom durations, end dates and discounts, always within the features and limits available in Comminari.

The creator is responsible for reviewing that each published plan correctly reflects price, currency, duration, periodicity, benefits, renewal conditions and any relevant limitation.

Comminari may block, deactivate or limit plans that contain technical errors, breaches, fraud risk, permission loss or incompatibilities with the group or Stripe configuration.

8. Comminari fees

Comminari may receive a fee for charges processed through the platform. The applicable percentage depends on the creator's tier and the computable monthly gross volume under the current rules.

The tier is recalculated on the 1st day of each month using the previous month's gross volume, prorating payments according to the covered access period, subtracting refunds or disputes where applicable and normalizing currencies to EUR when needed.

Comminari fees are independent from fees, withholdings, costs, taxes or charges that Stripe or other third parties may apply to the creator.

9. Disputes, refunds and failed payments

Disputes, refunds, chargebacks, failed payments, expired subscriptions or cancellations may affect end-user access and the financial activity shown in Comminari.

The creator is responsible for handling claims related to content, commercial promises, service quality, internal rules or continuity of their community.

Comminari may provide technical support related to checkout, Telegram validation, link generation, payment status, event reconciliation and platform operation.

10. Acceptable use

The creator may not use Comminari for illegal, fraudulent, misleading or abusive activities, activities that infringe third-party rights, bypass technical controls, generate spam or breach Telegram, Stripe or other provider terms.

It is prohibited to use the platform for impersonation, sale of unauthorized access, payment manipulation, concealment of relevant information from the buyer, exploitation of vulnerabilities or any conduct that may harm users, third parties, providers or Comminari.

Comminari may investigate, limit, suspend or close accounts, groups, plans or charges when it detects reasonable signs of breach, fraud, legal risk, operational risk or harmful platform use.

11. Data and privacy

The processing of personal data by Comminari is governed by the Privacy Policy published at /privacy.

The creator must use data visible or accessible from Comminari only to manage their community, handle legitimate incidents and comply with their obligations, avoiding unauthorized uses, improper transfers or unsolicited communications.

The creator is responsible for complying with privacy obligations that apply to their own processing outside Comminari or inside their Telegram community.

12. Suspension and termination

The creator may stop using Comminari or disconnect communities according to the available features, without prejudice to pending obligations, ongoing payments, disputes, legal obligations or data that must be retained.

Comminari may suspend or cancel the creator's access to the platform, limit charges, deactivate plans or archive resources in case of breach, fraud, security risk, loss of permissions, provider instructions, legal requests or harmful use.

Suspension or termination does not release the creator from responsibility for prior obligations toward end users, Stripe, authorities, third parties or Comminari.

13. Changes to the Terms

Comminari may update these Terms to reflect legal, technical, operational, financial or product changes.

When a change is relevant, Comminari may ask the creator for new acceptance before continuing to use certain features.

Historical versions may remain available for consultation and proof of acceptance.

14. Governing law

These Terms will be interpreted primarily under Spanish law, without prejudice to mandatory rules that may apply.

If a translation is published, the Spanish version will prevail in case of discrepancy, unless an applicable mandatory rule provides otherwise.
